GENERAL

By accessing, visiting and/or using this website, or any part thereof, you agree and consent to all of the terms and conditions herein.
This agreement is made between you and HBM Medical Clinic Sdn. Bhd. (as operator of the HBM Family Clinic) and all its affiliated entities whether individually, collectively or in any such other combination (hereinafter referred to as “HBM”).
The terms, conditions, representations, information, materials and/or all other forms of content of this agreement, this website, as well as pertaining to any of the services and/or products referred thereto, may be amended, altered, replaced, updated deleted and/or discontinued, whether in whole or in part thereof, without any notice to you.

PRICE AND INCENTIVES
Service prices listed on this website are subject to change without any notice to you. You further acknowledge and agree that prices listed may be susceptible to human and system errors. In the event where any accepted order is affected by such a price error, you agree that HBM shall be entitled to refuse performance of such accepted order and that you consent to withdraw such accepted order. In such an event, you agree that a refund of the accepted order amount shall be the full and final relief that is adequate and sufficient to fully discharge any and all claims by you.
All service prices displayed on this website are not inclusive of applicable taxes (if any). All applicable taxes (if any) can be calculated and viewed during the checkout process.
From time to time certain incentives may be offered, such as coupons, discounts, rebates, free gifts, and/or any other incentives pertaining to your purchases with HBM. Depending on the type of incentive, the same may be subject to a time period limitation and/or to stock availability and may only be offered for a limited time only and/or while such stocks are available. Such incentives are offered strictly on a goodwill basis and may be varied, revoked, and/or terminated at any time.

PURCHASE
HBM attempts to be as accurate as possible when describing its services on this website. However, to the extent permitted by applicable law, it is not warranted that the service descriptions, information or other content available on this website are error-free. You further acknowledge and agree that the actual performance of the service may slightly differ from the photographs displayed on this website.
All services displayed on this website is subject to availability. Due to the nature of e-commerce and online platforms, there may be discrepancies in the availability as listed on this website.
Any and all orders and payment shall only be placed and made by you in accordance with the methods that are expressly available on this website. Any orders placed by you shall only constitute a valid offer to purchase by you if it is accompanied by the required payment.
All orders placed by you are offers to purchase made by you to HBM and are subject to our acceptance. Your order shall only be regarded as accepted (“accepted order”) upon HBM performing its service for you at the designated location.
In the event that payment has been made by you but your order has not been accepted by HBM, you will be notified of such non-acceptance and your payment will be refunded. In any event, you agree that HBM has the right to refuse to perform any accepted and paid orders and in such a situation, a refund of the affected order shall be the full and final relief that is adequate and sufficient to fully discharge any and all claims by you.

TRAVELLING COSTS
Unless otherwise expressly stated, in the event where you require the performance of HBM’s services at your own designated location, the cost of HBM’s servants and/or contractors travelling to your designated location (including all applicable taxes, if any) shall be borne by you separately and is not included in the service price.
Unless otherwise expressly stated, such cost of travelling will be advised upon your enquiry and will vary depending on the designated location. Additionally, advance payment for such services and/or travelling costs shall be required from you.
The arrival of HBM’s servants and/or contractors at your designated location and in a timely manner is subject to the genuineness and accuracy of the information provided by you including, but not limited to, your full name, current address, phone number, and email address.
All manners and methods of travelling by HBM’s servants and/or contractors are as per the manners and methods practiced in usual travel and are subject to reasonable delays resulting from vicissitudes of life (such as government policies, congestion, festivities, holidays, ordinary working hours, and the like) as well as any flaws, unforeseen circumstances, frustrating events, acts of god, errors and/or inaccuracies.

REFUND
The performance of all services by HBM is on an “as is” basis and you shall have no further claims against HBM upon the performance of such services, including but not limited to, on any issues of efficacy and/or compatibility.
You acknowledge and agree that the efficacy and/or compatibility of HBM’s services may be influenced by any medication and/or products that are medically recommended to be used for the performance of such services. You agree that HBM has no control whatsoever over the manufacture and/or production of such medication and/or products and you shall have no claims against HBM for any issues of efficacy and/or compatibility that are attributable to such medication and/or products.
You acknowledge and agree that the efficacy and/or compatibility of HBM’s services (including the use of any medication and/or products that are medically recommended to be used for the performance of such services) may also be influenced by your own personal health condition that are specially known only to you and/or that would not be within the knowledge of HBM. As such, you agree that you shall have no claims against HBM for any issues of efficacy and/or compatibility that are attributable to your personal health condition.
Refunds may only be requested by you in the event that HBM is unable and/or has refused to carry out the accepted order. The process for refunds shall be in accordance with the methods as described in this website from time to time and/or as communicated by HBM to you from time to time.
Any refunds are strictly a gesture of goodwill and do not amount to any form of admission of liability, and it shall be the full and final relief that is adequate and sufficient to fully discharge any and all claims by you.

INTELLECTUAL PROPERTY
All forms of intellectual property (including but not limited to, marks, trademarks, copyrights, designs, industrial designs, patents, database rights and/or confidential information, whether the same is registered or unregistered) as displayed, available, accessible, and/or inferred via this website vests and remains as HBM’s property.
Nothing in the terms herein shall grant you any form of permission, license, and/or rights to use (and in terms of confidential information, to further disclose or put to risk of disclosure) HBM’s intellectual property rights.

DISCLAIMERS AND LIMITATION
You acknowledge and understand that this website is built upon a third party online platform(s). You acknowledge and agree that the transfer of any data as well as security between the aforementioned online platform(s) with your browsing device (including but not limited to, computer, laptop, tablet, smartphone, and any other device of similar browsing capability) is not within our control and that you shall have no claims against HBM in the event of any transmission of any viruses, malware, and/or similar compromising data between the aforementioned online platforms with your browsing device.
In the event of any non-performance of your accepted orders that is attributed to HBM, you agree and acknowledge that you shall have no claim as to any form of damages (whether general, special, incidental, consequential, contemptuous, exemplary, aggravated, or otherwise) and that a refund of the accepted order amount shall be the full and final relief that is adequate and sufficient to fully discharge any and all claims by you. You further acknowledge and agree that HBM shall be deemed to have no knowledge as to the purpose of you offering to purchase any service from this website (apart from being a consumer) and that any form of damages, losses, and/or costs that may be suffered and/or incurred by you are unforeseeable, too remote, and do not naturally flow from the ordinary course of dealings with HBM.

ASSIGNMENT
All rights and liabilities pursuant to any accepted order shall be assignable by HBM to any third party without your consent.
All of your rights and liabilities pursuant to any accepted order shall not be assignable by you to any third party without HBM’s express consent.

SEVERABILITY
In the event where any term herein is invalidated, all other remaining terms shall continue to remain in force as if the invalidated term has been severed and do not form part of the terms herein, provided always that the intention of the parties are not defeated.

JURISDICTION
The terms herein shall be governed by the laws of Malaysia and that you hereby irrevocably submit to the exclusive jurisdiction of the Malaysian courts.
